End-User License Agreement (EULA)

Effective Date: June 8, 2025

This End-User License Agreement (“EULA”) is a legal agreement between you (“you” or “Licensee”) and Login AlertX (“we,” “us,” or “our”), governing your use of the Login AlertX software, which includes a monitoring service and a Windows application (collectively, the “Software”). By installing, accessing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.

1. Software Description

The Software consists of:

  • A monitoring service (LoginMonitorService) that detects login events (e.g., lock+login, logout+login, first-time login after shutdown/restart, sleep+login, hibernate+login, remote desktop) and sends signals via a named pipe.
  • A Windows application that receives signals from the service, validates premium features, manages user-configurable settings (e.g., SMTP or Google OAuth for notifications), and sends login notifications. Premium features include audio recording and webcam capture.

Use of the Software is subject to a valid subscription or a 30-day trial, governed by our Terms of Service (“TOS”), available at loginalertx.com.

2. License Grant

Subject to your compliance with this EULA and the TOS, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software on a single device for personal or internal business use during the term of your active subscription (monthly or yearly) or during the 30-day trial period. The license includes:

  • Core Features: Basic login event monitoring and notifications, accessible with a free or paid subscription or during the 30-day trial.
  • Premium Features: Enhanced notifications, advanced configuration settings, audio recording (via NAudio), and webcam capture (via AForge), available during the 30-day trial or with a paid subscription and a valid serial key, validated via our server at loginalertx.com.

3. License Restrictions

You may not:

  • Modify, adapt, translate, decompile, disassemble, or reverse-engineer the Software, except as permitted by applicable law.
  • Copy, distribute, sublicense, sell, lease, or transfer the Software or any serial key to any third party.
  • Use the Software on multiple devices under a single license, unless expressly permitted by your subscription.
  • Bypass, tamper with, or disable premium feature validation or any security measures in the Software.
  • Use the Software for illegal purposes or to violate the privacy or rights of others, including unauthorized monitoring, audio recording, or webcam capture.
  • Remove or alter any copyright, trademark, or proprietary notices in the Software.

4. Subscription and Premium Features

The Software’s functionality depends on your subscription tier or trial period:

  • Free Tier: Provides access to core features, including basic login event monitoring and limited configuration options, available during and after the 30-day trial.
  • Premium Tier: Unlocks enhanced notifications, advanced settings, audio recording, and webcam capture, available during the 30-day trial or with a paid subscription requiring a valid serial key. The Windows application validates the serial key with our server at loginalertx.com.

You are responsible for maintaining the security of your serial key and ensuring a stable internet connection for premium feature validation after the 30-day trial. We may disable premium features if validation fails due to an invalid or expired subscription.

5. User Responsibilities

You are responsible for:

  • Installing and configuring the Software correctly, including SMTP settings or Google OAuth for notifications and enabling/disabling premium features (e.g., audio recording, webcam capture).
  • Using Google OAuth for email notifications, where your Google account credentials are securely stored in Windows Credentials on your device, and ensuring the security of these credentials.
  • Ensuring your device meets the Software’s system requirements, including Microsoft .NET Framework 4.7.
  • Securing any client application or system receiving data from the Software’s named pipe. We are not liable for unauthorized access to pipe communications due to your failure to secure your systems.
  • Ensuring your use of the Software complies with all applicable laws, including data protection and privacy regulations (e.g., GDPR, CCPA). For premium features like audio recording and webcam capture, you must:
    • Obtain explicit consent from individuals whose audio or video is recorded, where required by law.
    • Comply with local laws regarding surveillance, data collection, and storage.
    • Securely store and protect any recorded audio or video to prevent unauthorized access.
  • Maintaining the security of your subscription account and serial key.

6. Updates

We may provide updates, patches, or new versions of the Software to improve functionality, fix bugs, or address security issues. Updates are subject to this EULA. You are responsible for installing updates to maintain compatibility and performance. We may automatically deliver updates as part of your subscription or trial.

7. Intellectual Property

The Software and all related materials, including code, documentation, and trademarks, are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You do not acquire any ownership rights in the Software. The “Login AlertX” name and logo are our trademarks and may not be used without written permission.

8. Third-Party Dependencies

The Software includes prebundled third-party components, including AForge, Google.Apis, MailKit, Microsoft.Identity, NAudio, Newtonsoft.Json, and additional Windows system libraries, which are subject to their respective licenses. We are not responsible for the performance or availability of these third-party components.

9. Privacy

The Software collects and processes data, such as usernames, session IDs, timestamps, serial keys, user-configured settings (e.g., SMTP or Google OAuth settings), and, for premium users during the trial or with a subscription, audio recordings and webcam captures. Our Privacy Policy, available at loginalertx.com, governs how we handle your data. By using the Software, you agree to the Privacy Policy and acknowledge that you are responsible for ensuring compliance with applicable data protection laws, particularly for audio and webcam data.

10. Termination

This EULA and your license to use the Software will terminate if:

  • Your subscription or 30-day trial expires or is canceled, as governed by the TOS.
  • You violate any terms of this EULA or the TOS.
  • We discontinue the Software or its support, with notice as per the TOS.

Upon termination, you must cease all use of the Software, uninstall it from your device, and delete any audio or webcam data collected. Premium features may be disabled remotely upon termination or expiration of the 30-day trial.

11. Disclaimer of Warranties

The Software is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee:

  • The Software will meet your requirements or operate without errors.
  • All login events will be detected or notifications delivered successfully.
  • Audio recording or webcam capture will function on all systems or meet specific quality standards.
  • Compatibility with all systems or third-party applications.

12. Limitation of Liability

To the fullest extent permitted by law, we, our affiliates, and our licensors are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Software, including but not limited to:

  • Loss of data, privacy, or profits.
  • Failures due to system incompatibilities, network issues, or misconfiguration.
  • Unauthorized access to named pipe communications, audio recordings, or webcam captures.

Our total liability is limited to the amount you paid for your subscription, if applicable, excluding the 30-day trial period.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Software, including violations of this EULA, misuse of audio or webcam features, or non-compliance with applicable laws (e.g., privacy regulations).

14. Governing Law and Jurisdiction

This EULA is governed by the laws of India, without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts located in Bengaluru, Karnataka, India. You agree to submit to the jurisdiction of these courts.

15. Entire Agreement

This EULA, together with the TOS and Privacy Policy, constitutes the entire agreement between you and us regarding the Software. If any provision of this EULA is found invalid, the remaining provisions will remain in effect.
